Objectives
Upon completion of this independent study, the learner will be able to:
- Distinguish the nurse attorney's two separate credentials, explaining which body issues a nursing licence and what that body does with it.
- Explain why legal answers are jurisdiction-specific, using the structure of one state's nursing law as a worked illustration rather than a national rule.
- State the four elements a plaintiff must prove in a medical malpractice action and what question each element asks.
- Describe the retrieved tort liability pathway and explain where an omission of action fits within it.
- Explain joint and several liability and vicarious liability as the retrieved review defines them.
- State how the retrieved review defines standard of care and explain why the comparison is to a similarly trained clinician rather than to a perfect one.
